Filing 5 ORDER RE CIVIL RIGHTS COMPLAINT by Judge Cormac J. Carney. 1. Plaintiff's official capacity claims for punitive damages are dismissed without leave to amend and with prejudice. 2. The Complaint otherwise is dismissed with leave to amend. If Pla intiff still wishes to pursue this action, he is granted thirty (30) days from the date of this Order within which to file a First Amended Complaint. Failure to file timely a First Amended Complaint in conformity with this Order may result in the dis missal of this action. 3. Within thirty (30) days of the date of this Order, Plaintiff must file a separate writing attempting to show cause, if any there be, why the action should not be transferred to the United States District Court for the Eastern District of California. Failure to do so may be deemed consent to the transfer. SEE ORDER FOR DETAILS. (dml) |
