MINUTES (IN CHAMBERS) by Judge David O. Carter Re: Order granting in part and denying in part 11 MOTION to Dismiss ; granting 19 MOTION to Dismiss Case. For the reasons set forth above, Amtrak's Motion to Dismiss is GRANTED IN PART an d DENIED IN PART. Plaintiff's negligent hiring, supervision, or retention claim is DISMISSED WITHOUT PREJUDICE to plead additional facts supporting an inference of knowledge. The Amtrak Motion is DENIED in all other respects. Orange Coun ty's Motion to Dismiss is GRANTED. Plaintiff's FEHA claims are DISMISSED WITHOUT PREJUDICE. Plaintiff's negligence claim is DISMISSED WITH PREJUDICE. Plaintiff may file an amended complaint, if desired, on or before September 14, 2015. The Clerk shall serve this minute order on the parties.
