Filing 125 ORDER re Findings of Fact and Conclusions of Law pursuant to Rule 52(a) of the Federal Rules of Civil Procedure and granting 64 Motion to Apply the Appropriate Standard of Care. Plaintiffs have failed to establish by a preponderance of the eviden ce that they are entitled to prevail on the three causes of action alleged in the Complaint. It is hereby ordered that the Clerk of Court shall enter judgment in favor of Defendants BAE Systems San Diego Ship Repair Inc. and United States and against Plaintiffs Phillip Marable and Gisela Marable as to all causes of action in the Complaint. It is hereby ordered that the cross-claims for contribution and indemnity by the United States and BAE Systems are dismissed.
