Court dismisses with prejudice Plaintiff's claims for breach of contract (Count 1), breach of implied covenant of good faith and fair dealing (Count 2), a UCL claim under the unlawful and fraudulent prongs (Count 3), the declaratory judgment request as pleaded (Count 4), and fraud (Count 6). Court dismisses without prejudice Plaintiff's claim for a preliminary and permanent injunction (Count 5). Court sustains Plaintiff's UCL unfair p rong claim (Count 3) and negligence claim (Count 7). Plaintiff is granted leave to amend the First Amended Complaint. Plaintiff may file Second Amended Complaint by 7/24/2018. Failure to file an second amended complaint by this date will result in this case proceeding only as to those claims not dismissed by this Order.
