| August 22, 2006 | 3 |  INITIAL REVIEW ORDER DISMISSING CASE: Application to proceed in forma pauperis is granted. Clerk of Court shall file the complaint for the purpose of making a record. Prisoner Jerome Davis is directed to submit monthly payments of 20% of the pr eceding month's income credited to his inmate account until the $350 filing fee is paid. The agency having custody of plaintiff shall forward payments from his inmate account to the Clerk of Court each time the amount exceeds $10 until the filing fee is paid. The plaintiff's complaint is dismissed. The dismissal of this action counts against the plaintiff for purposes of the three-dismissal rule. Signed by Judge Linda R Reade on 8/22/06.
