ORDER: The Report and Recommendation filed June 20, 2012 (Doc. No. 18 ), is ADOPTED and CONFIRMED and made a part of this Order. This case is DISMISSED for lack of subject matter jurisdiction. The Court declines to exercise supplemental jurisdictio n over the state law claims pursuant to §1367. The Court retains jurisdiction over the issue of whether either counsel had the authority to file the case or dismiss the case.
