ORDER DISMISSING BAD FAITH CLAIM - The motion to dismiss Count II of the complaint, ECF No. 6 , is GRANTED. Mr. Webber's bad faith claim under section 624.155, Florida Statutes, ECF No. 1 , Count II, is DISMISSED with prej udice. Mr. Webber's motion to compel, ECF No. 17 , is DENIED as moot. GMAC's motion to strike Mr. Webber's supplemental memorandum of law, ECF No. 31 , is GRANTED in part. This action will proceed under Count I. The parties must comply with the scheduling order.
