First, the Court denies Defendants' motion to dismiss Count V (Medical Monitoring). Illinois and federal courts applying Illinois law have recognized a tort claim for medical monitoring. Lewis v. Lead Indus. Ass'n 793 N.E.2d 869, 874 (Ill. App. Ct. 2003); see Frye v. L'Oreal USA, Inc., 583 F. Supp. 2d 954, 958-59 (N.D. Ill. 2008) (assuming medical monitoring claim exist under Illinois law); Jensen v. Bayer AG, 862 N.E.2d 1091, 1100 (7th Cir. 2007) (same); Carey v. Kerr-McGee Chem. Corp., 999 F. Supp. 1109, 1119 (N.D. Ill. 1998) (holding that Illinois Supreme Court would recognize a medical monitoring claim). Plaintiffs allege that for about a year, they were exposed to high levels of toxic mold, as well as disturbed friable asbestos, and that they face an increase risk of harm due to their exposure. It may be reasonably inferred from these allegations that medical monitoring for conditions related to such exposure is necessary and available. These allegations are thus sufficient to state a medical monitoring claim. Second, Defendants have misread Count VII as bringing a deceptive practices claim under the Illinois Consumer Fraud Act ("ICFA") and argue that Plaintiffs have failed to satisfy the heightened pleading standard of Federal Rule of Civil Procedure ("Rule") 9(b). However, Plaintiffs assert that Count VII merely alleges an unfair practices claim (rather than a deceptive practices claim) under the ICFA, and thus, the Court holds that the pleading standard of Rule 8(a) applies. Plaintiffs allege that Defendants failed to disclose to tenants that leased property was contaminated with mold or asbestos, and this is sufficient to allege a plausible unfair practice claim under the ICFA. A federal court's inability to "review moot cases derives from the requirement of Article III of the Constitution under which the exercise of judicial power depends upon the existence of a case or controversy." Liner v. Jafco, Inc., 375 U.S. 301, 306 n.3 (1964). "Federal courts are without power to decide questions that cannot affect the rights of litigants in the case before them." North Carolina v. Rice, 404 U.S. 244, 246 (1971) (per curiam). Thus, this Court necessarily looks to federal law, rather than state law, to determine whether a justiciable case or controversy exists. See, e.g., Gates v. City of Chi., 623 F.3d 389, 413 (7th Cir. 2010) (applying federal law to determine whether state law claim of restitution was moot). Because the applicable federal law has not changed, the Court denies Plaintiffs' second motion to reconsider #105 . In addition, the Court denies Plaintiffs' request in the alternative to certify its May 7, 2014 Order for interlocutory appeal pursuant to 28 U.S.C. 1292(b) for the same reasons provided on the record at the June 5, 2014 hearing.
