ORDER DISMISSING CASE with prejudice: IT IS HEREBY ORDERED that Plaintiff is restricted from filing any new civil actions in this Court until such time as his outstanding filing fees of $7,455 have been paid in full. This filing restriction doe s not extend to a notice of appeal from this Order, to the filing of any petition for a writ of habeas corpus, or to pleadings filed as a defendant in another criminal or civil case. Plaintiff may seek reconsideration of this Order by filing a motio n in this Court no earlier than two years from the date of entry of this Order. ORDER denying 2 MOTION for Leave to Proceed in forma pauperis filed by William Owen Spivey II. Plaintiff is hereby ORDERED TO SHOW CAUSE why this Court should not restrict Plaintiff from filing any further actions in this Court until such time a s Plaintiff pays the $350 filing fee for this action and the outstanding $7,105 owed for his previously filed and/or other pending actions in full. Tender by Plaintiff of the full $7,455 in outstanding fees for these actions to the Cl erk of the Court on or before May 17, 2013, shall be deemed by the Court to discharge Plaintiff's duty to show cause under this order. Further, unless full payment of Plaintiff's outstanding fees is received by this deadline, the instant case shall be dismissed with prejudice. (Action due by 5/17/2013). Signed by Judge J.
