Filing 114 ENTRY ON MOTIONS IN LIMINE - Plaintiff's Motion in Limine (Dkt. # 102 ) is GRANTED. Defendants' Motion in Limine (Dkt. # 93 ) is GRANTED to the extent it applies to settlement negotiations, back pay and front pay, and other lawsuits involv ing the State of Indiana, the Indiana State Department of Health or the individual Defendants. The Court reserves ruling until the final pretrial conference to the extent Defendants' motion applies to references to alleged race discrimination or racially discriminatory statements. Signed by Judge Tanya Walton Pratt on 7/18/2012. (JD) |
Filing 80 ENTRY - Defendants' Motion for Summary Judgment (Dkt. 58 ) is GRANTED in part and DENIED in part. Williams' claim for retaliation arising out of his November, 24 2008 transfer will survive for trial. Summary judgment is GRANTED with respec t to all remaining claims. Finally, given the Court's ruling, it need not address in detail the issues presented by Defendants' Motion to Strike Plaintiff's Affidavit. Such motions are disfavored by the local rules. Suffice it to say, the Court has endeavored to consider the admissible portions of Williams' affidavit while disregarding the inadmissible portions. Accordingly, Defendants' Motion to Strike the Affidavit of Micah Williams (Dkt. 72 ) is DENIED as moot. Signed by Judge Tanya Walton Pratt on 11/17/2011. (JD) |
