MEMORANDUM AND ORDER sustaining in part 21 Motion for Judgment on the Pleadings. The Court dismisses the City's claims for failure to state a claim. IT IS FURTHER ORDERED that BP's oral motion to dismiss the City's claims with prej udice under Rule 41(b), Fed. R. Civ. P., for failure to prosecute is SUSTAINED. IT IS FURTHER ORDERED that the City Of Neodesha's 41 Motion to Remand is overruled. IT IS FURTHER ORDERED that the City's oral motion to dismiss without pr ejudice under Rule 41(a)(2), Fed. R. Civ.
