MEMORANDUM OPINION by Senior Judge Thomas B. Russell on 4/9/13; Defendants 17 Motion for Summary Judgment is GRANTED to the extent that the Plaintiffs are prohibited from obtaining statutory penalties pursuant to KRS § 382.365. The Plaintiff s motion 18 is GRANTED, but only to the extent that they may recover reasonable attorneys fees for obtaining release of the satisfied mortgage through commencement of this action. In all other aspects the Plaintiffs motion is DENIED. A separate order shall follow. cc:counsel (DAK)
