September 29, 2011 Opinion or Order Filing 298 ORDER 1. Granting in part and denying in part Buffalo Wings & Rings, LLC's 192 Motion in Exclude Plaintiff's Damages Expert. Motion is granted insofar as Ludington may not offer testimony abo ut a reasonable royalty rate. Motion is denied in all other regards. 2. Granting in part and denying in part Buffalo Wild Wings, Inc.'s 199 Motion to Exclude Expert Testimony of John Campbell, Joan Dillon and Craig Siiro. Moti on is granted insofar as Siiro shall be prohibited from opining that royalties are not an available measure of damages in a trademark infringement case and that BWW cannot recover damages for infringement by BWR franchisees. The Court further prohibits Siiro from relying on the parties' pre-suit settlement discussions. Motion is denied in all other regards (Written Opinion). Signed by Judge John R.
