No. 47] is GRANTED IN PART as to his statutory claim based on regular bistro service (Count One), and DENIED IN PART as to his claim for conversion (Count Two); 2. Defendant's Motion for Summary Judgment [Doc. No. 51] is GRANTED IN PART as to Plaintiff's claims for unjust enrichment and conversion (Counts Two and Three), DENIED IN PART as to Plaintiff's statutory claim based on regula r bistro service (Count One), and DENIED WITHOUT PREJUDICE in part as to Plaintiff's statutory claim based on event service (Count One); 3. Plaintiff may conduct additional discovery related to his statutory claim based on event service as se t forth herein, within 60 days; and 4. The parties are ordered to contact Magistrate Judge Jeffrey Keyes' chambers immediately to schedule a settlement conference which must occur in the next 60 days (Written Opinion).
