Deck for writ of habeas corpus 30 is granted as to the sentence of death only, based on Claims 31 and 32(a) as discussed above, and denied in all o ther respects. Petitioners death penalty is vacated. Because the constitutional deficiencies cannot be cured and Deck cannot now be subjected to a penalty-phase trial that comports with due process, he must be sentenced to life in prison without the possibility of parole.
