April 13, 2017 Opinion or Order Filing 86 MEMORANDUM AND ORDER (See Full Order) IT IS HEREBY ORDERED that the amended petition of Carman L. Deck for writ of habeas corpus 30 is granted as to the sentence of death only, based on Claims 31 and 32(a) as discussed above, and denied in all o ther respects. Petitioners death penalty is vacated. Because the constitutional deficiencies cannot be cured and Deck cannot now be subjected to a penalty-phase trial that comports with due process, he must be sentenced to life in prison without the possibility of parole. IT IS FURTHER ORDERED that respondents shall have until December 4, 2015, to respond to Deck's supplemental Memorandum. Any Traverse shall be filed not later than December 28, 2015.
