May 16, 2012 Opinion or Order Filing 12 MEMORANDUM AND ORDER - The Clerk of the court is directed to re-open this matter. Plaintiff's monetary damages claim against Barker in her official capacity only is dismissed without prejudice in accordance with this Memorandum and Order. Plaintiff's First Amendment and Sixth Amendment claims for injunctive relief against Barker in her official capacity only may proceed. To obtain service of process on Barker in her official capacity, Plaintiff must complete and return the summons form which the Clerk of the court will provide. Plaintiff shall, as soon as possible, complete the forms and send the completed forms back to the Clerk of the court. Upon receipt of the completed forms, the Clerk of the court will sig n the summons form, to be forwarded with a copy of Plaintiff's Complaint to the U.S. Marshal for service of process. The Marshal shall serve the summons and the Complaint without payment of costs or fees. The Clerk of the court will copy the Complaint (Filing No. 1 ) and Plaintiff does not need to do so. Plaintiff is granted, on the court's own motion, an extension of time until 120 days from the date of this order to complete service of process. Plaintiff is hereby noti fied that failure to obtain service of process on a defendant within 120 days of the date of this order may result in dismissal of this matter without further notice as to such defendant. Plaintiff shall keep the court informed of his current address at all times while this case is pending. Failure to do so may result in dismissal. Plaintiff's Motion for Leave to Appeal In Forma Pauperis (Filing No. 10 ) is denied as moot. Ordered by Chief Judge Laurie Smith Camp.
