MEMORANDUM AND ORDER that the clerk of the court is directed to correct the docket sheet to change the name of the first-named Defendant from "Allied Interstate LLC, Inc." to "Allied Interstate LLC". Defendants' Rule 12(b)(6) motion to dismiss 34 is granted as to all claims alleged under the Fair Debt Collection Practices Act, 15 U.S.C. §§ 1692 et seq., (Count I of Plaintiff's complaint), and such claims are dismissed with prejudice. All state-law claims alleged under the Nebraska Consumer Protection Act, Neb. Rev. Stat. §§ 59-1601 et seq. (Count II of Plaintiff's complaint), are dismissed without prejudice pursuant to 28 U.S.C. § 1367(c)(3). Judgment shall be entered by separate document. Ordered by Senior Judge Richard G. Kopf. (JSF)

On or before September 8, 2014, the parties shall: discuss what information they respectively need at this time to consider whether this case can be settled withou t substantial discovery and incurring the related costs and fees; provide to the court a listing of the discovery needed to determine if the case is suitable for early settlement; and advise the court regarding when such discovery can be reasonably compiled and produced. MEMORANDUM AND ORDER that the plaintiff's motion 13 is granted. Defendants' Offer of Judgment 10 is stricken from the court's docket, but nonetheless remains operative to the extent allowed under Rule 68 of the Federal Rules of Ci vil Procedure. Briefing on the plaintiff's motion to certify a class 7 is stayed pending further order of the court. Counsel for the parties shall confer and, on or before August 21, 2014, they shall jointly file a Form 35 (Rule 26 (f)) Report . If one or more of the parties believes a planning conference is needed to complete the Rule 26(f) Report, or if the parties cannot agree on one or more of the deadlines identified or case progression issues raised in the Rule 26(f) Report, on or before August 14, 2014, a party shall contact my chambers.
