MEMORANDUM AND ORDER - Having observed Claimant as she testified, the court finds Claimant's testimony was not entirely credible: Her claim of ownership, dominion and control over the vehicle is not plausible. The Claimant has failed to meet her burden of showing by a preponderance of the evidence that she is an innocent owner of the 2009 Dodge Challenger. Accordingly, 1) The claim of Carol Scarborough, against defendant 2009 Dodge Challenger, (Filing No. 28 ), is denied and dismissed.2) Judgment will be entered in accordance with this memorandum and order.Ordered by Magistrate Judge Cheryl R.
