March 4, 2015 Opinion or Order Filing 26 MEMORANDUM AND ORDER that Plaintiff's request for the appointment of counsel 25 is denied without prejudice. Plaintiff's requests to sever claims 17 and 24 are granted only to the extent set forth below. Plaintiff's requests to n ame additional defendants is granted. Plaintiff's claims against the Saunders County Jail and Saunders County, Nebraska, are severed into a new case. That new case shall be captioned: CAMERON CHRISP, Plaintiff, vs. SAUNDERS COUNTY JAIL, AND SAUN DERS COUNTY, NEBRASKA, Defendants. The new severed case shall be assigned to the undersigned judge for further proceedings. The clerk of the court is directed to file the following documents in the new case: this order; the original Complaint (Fili ng No. 1); Plaintiff's Motion for Leave to Proceed in Forma Pauperis (Filing No. 8), which should be pending at the time the case is opened; and any other notices and general orders that are filed in pro se cases as amatter of course (e.g., the "NOTICE by Clerk acknowledging receipt ofcomplaint by a pro se party"). The clerk's office is directed to terminate Saunders County Jail as a defendant in this action and add Lancaster County, Nebraska, as a defendant in this action in accordance with this Memorandum and Order. December 29, 2014 Opinion or Order Filing 15 MEMORANDUM AND ORDER that the filing fee shall be collected and remitted, as funds exist, in the manner set forth in 28 U.S.C. § 1915(b)(2). Until the full filing fee of $350.00 is paid, the prisoner shall be obligated to pay, and the agenc y having custody of the prisoner shall forward to the Clerk of Court, 20 percent of the preceding month's income in such months as the account exceeds $10.00. The Clerk of Court shall serve a copy of this order on the appropriate financial officer for Plaintiff's current institution. Plaintiff shall continue to keep the court informed of his current address at all times while this case is pending, as failure to do so may result in dismissal of thismatter.
