May 28, 2014 Opinion or Order Filing 4 MEMORANDUM AND ORDER directing the Clerk to reopen Artfitch v. United States, Civil No. 14-2221, by making a new and separate entry on the docket reading, CIVIL CASE REOPENED. The Clerk of the Court shall forward Petitioner a blank § 2255 form titled AO243 (modified): DNJ-Habeas-004 (Rev. 01-2014) for Petitioners completion and filing in Artfitch v. United States, Civil No. 14-2221. Petitioners time to reopen Artfitch v. United States, Civil No. 14-2221, is extended, and if he wishes to r eopen Artfitch v. United States, Civil No. 14-2221, he shall so notify the Court, in a writing addressed to the Clerk, within 30 days of the date of entry of this Memorandum and Order. Petitioners writing shall include a complete, signed habeas petit ion on the appropriate form served to him by the Clerk. Upon receipt of a writing from Petitioner stating that he wishes to reopen Artfitch v. United States, Civil No. 14-2221, and a complete, signed petition on the new form, containing a signed Mill er notice, the Clerk will be directed to reopen Artfitch v. United States, Civil No. 14-2221. The Clerk shall administratively terminate Artfitch v. United States, Civil No. 14-2221, by making a new and separate entry on the docket reading, CIVIL CASE TERMINATED SUBJECT TO REOPENING UPON TIMELY RECEIPT OF PETITIONERS ALL-INCLUSIVE MOTION ON THE PROPER FORM; etc. Signed by Judge Stanley R. April 22, 2014 Opinion or Order Filing 3 MEMORANDUM AND ORDER that the Clerk of the Court shall administratively terminate this matter, without filing the motion; and Petitioner is informed that an administrative termination is not a dismissal for purposes of the statute of limitations, and if this matter is reopened in accordance with the terms of this Memorandum and Order, it is not subject to the statute of limitations time that bar if Petitioners original submission in this matter was filed timely. The Clerk of the Court shall forw ard Petitioner a blank section 2255 form. If Petitioner wishes to reopen this matter, he shall so notify the Court in writing, addressed to the Clerk of the Court, within 30 days of the date of entry of this Memorandum and Order.
