Since Plaintiff's complaint fails to state a claim upon which relief may be granted or assert a ba sis for federal subject matter jurisdiction, this action is hereby dismissed with prejudice pursuant to 28 U.S.C. § 1915(e)(2)(B)(ii) and Fed. R. Civ. P. 12(h)(3). The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal f rom this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
