MEMORANDUM AND ORDER: Sprint elicited evidence suggesting defendants business was not always on the up-and-up. But Yusupovs petulant deposition testimony, the fact that iCell Guru bought bad ESN phones (allegedly for parts), and the existence of counterfeiting materials at iCell Gurus place of business does not establish what is necessary for Sprint to recover under the Lanham Act and New York unfair competition law: that iCell Guru actually sold bad ESN Sprint phones. ORDER denying #7 Motion to Appoint Counsel: As an initial matter, there is no right to counsel in a civil case. Martin-Trigona v. Lavien, 737 F.2d 1254, 1260 (2d Cir. 1984). Although the Court cannot compel an attorney to take a civil case without a fee, Mallard v. United States District Court, 490 U.S. 296, 309 (1989), it "may request an attorney to represent any person unable to afford counsel." 28 U.S.C. 1915(e)(1). In deciding a motion to appoint counsel, the preliminary inquiry is whether the moving party has met "a threshold showing of some likelihood of merit." Cooper v. Sargenti, 877 F.2d 170, 174 (2d Cir. 1989). At this time, Mr. Yusupov has made no such showing as to the substance of his defense and therefore his motion to appoint counsel must be denied. Further, Mr. Yusupov is advised that, although he may represent himself as a pro se litigant, he may not represent a corporation. See Pridgen v. Andresen, 113 F.3d 391, 393 (2d Cir. 1997). Thus, should defendant iCell Guru Inc. fail to retain counsel, the company will likely be held in default. Chambers staff is directed to send a copy of this Order to Mr. Yusupov.
