February 6, 2019 Opinion or Order Filing 230 ORDER: At telephone conferences on January 29 and 30, 2019, counsel for the parties and the court discussed the impropriety of ex parte letters to the court sent by interested individuals. Defense counsel advised at the January 30 conference that they had taken measures to advise their clients and their employees that letters should not be sent directly to the court and that defense counsel were aware that additional letters from defendants' employees had already been mailed to the court. A letter dated 1/21/19 (attached hereto), from defendant's COO, who testified and appeared daily at the trial, was received in chambers on 2/5/19, and reflected a misunderstanding about the litigation process and the role of the jury at trial. To the extent that this individual takes issue with the court's decisions on motions during which all parties had the opportunity to be heard, and believes that witnesses lied at trial, the judicial process requires the court to make decisions based on the facts and law presented by the motions, and further requires the trial jury to assess the evidence and determine the credibility of witnesses. Moreover, the jury was specifically instructed that their verdict must be based on the evidence at trial and the court's legal instructions, and not on anything that counsel or the court may have said during the trial. The court reserved judgment as to: (1) defendants' objections to plaintiffs' exhibits 26 and 152 and to plaintiffs' exhibits concerning alleged comparator evidence; and (2) plaintiffs' objections as to defendants' introduction of evidence concerning the religious nature of the use of incense in the workplace and Jordan's one-on-one meetings. The court denied defendants' request for a supplemental, written juror questionnaire. The parties reported that they: (1) resolved the outstanding issues regarding the admissibility of letters sent by the EEOC to claimants; (2) agreed not to mention the "cat's paw" theory of liability in their opening statements; and (3) agreed that the court will decide the issue of backpay, including mitigation. The parties will draft a stipulation of fact regarding Jordan's current relationship with the defendant companies. Plaintiffs withdrew their deposition designations for witnesses Hodes, Bourandas, and Levine and, instead, reserve the right to call them as hostile witnesses. While I am willing to change the date of the conference to accommodate the parties' schedules, one purpose of the conference scheduled for September 3, 2015, is to ensure that discovery is complete and to resolve any outstanding discovery so as to ensure that the record to be reviewed on a motion for summary judgment is complete. Another purpose is to assess whether a settlement can be reached without imposing on the parties and the court the burdens associated with dispositive motion practice. I therefore decline to relieve the parties of the obligation to submit ex parte statements of settlement position and to appear at the pretrial conference. If, after review of the ex parte statements, I am persuaded that a settlement conference is unlikely to be productive, and if the parties stipulate that all discovery is complete and that there are no outstanding discovery disputes, I will reconsider the foregoing ruling.
