September 30, 2015 Opinion or Order Filing 25 MEMORANDUM & ORDER granting in part and denying in part 12 Motion to Dismiss for Failure to State a Claim; For the foregoing reasons, Defendants' motion to dismiss the Complaint (Docket Entry 12) is GRANTED IN PART and DENIED IN PART. The motion is DENIED insofar as it seeks dismissal of Plaintiff's libel claims based on a failure to plead the "of and concerning" element of a defamation claim. The motion is GRANTED with respect to Plaintiff's right of privacy claims, which are DISMISSED WITH PREJUDICE. The motion is also GRANTED with respect to Plaintiff's fifth cause of action based on negligent defamation and this claim is DISMISSED WITHOUT PREJUDICE and with leave to replead. If Plaintiff wishes to file an amended complaint repleading this claim, he must do so within thirty (30) days of the date of this Memorandum and Order.
