Filing 21 MEMORANDUM AND ORDER granting in part and denying in part 15 Motion to Dismiss for Failure to State a Claim. For the foregoing reasons, Defendants' motion to dismiss is granted in part and denied inpart. Specifically, Defendants' motion to dismiss the federal RICO claim is granted and that claim is dismissed with prejudice. With respect to that portion of Defendants' motion that seeks a dismissal of the state law claims on their merits, that application is denied. Rather, the Court declines to exercise supplemental jurisdiction over the remaining state law claims and thoseclaims are accordingly dismissed without prejudice. The Clerk of the Court is directed to enter judgment accordingly and to thereafter close the file in this action. (Ordered by Judge Leonard D. Wexler on 10/30/2014.) (Fagan, Linda) |
