MEMORANDUM OF DECISION AND ORDER granting 10 Motion to Dismiss for Failure to State a Claim; denying 19 Motion to Strike as moot; It is hereby ORDERED, that the Defendants motion to dismiss the Plaintiffs Substantive Due Process claim pursuant to Fed. R. Civ. P. 12(b)(6) is granted and that claim is dismissed; and it is further ORDERED, that that Court declines to exercise supplemental jurisdiction over the Plaintiffs New York State breach of contract claim and that claim is dismissed with out prejudice; and it is further ORDERED, that the Plaintiffs letter motion to strike certain arguments raised in the Defendants reply papers is denied as moot; and it is further ORDERED, that the Clerk of the Court is directed to close this case.
