March 25, 2015	Filing 104 MEMORANDUM AND ORDER re: 90 Report and Recommendations. For the reasons stated herein, Judge Netburn's recommendations are adopted in full. Therefore, EMI's motion for summary judgment as to its Fifth and Sixth Claims for federal a nd common law copyright infringement is GRANTED except with respect to its claims for direct infringement of its right of reproduction. This resolves Dkt. No. 71. The Court hereby schedules a case management conference for Friday, May 8, 2015 at 1 1:30 a.m. No later than May 1, 2015, the parties shall submit a joint letter to the Court providing proposed trial dates and a proposed schedule for pre-trial submissions. The letter shall also indicate when further settlement talks will take place and whether the parties would like a referral to the Magistrate Judge or the Court-annexed mediation program for settlement.
