January 21, 2015 Opinion or Order Filing 12 ORDER: By order dated October 28, 2014, the Court granted Plaintiff sixty days to amend her complaint to provide facts supporting her Fair Labor Standards Act ("FLSA") claim. The Court directed Plaintiff to explain the manner in which the union's actions were arbitrary, discriminatory, or in bad faith. By letter dated December 2, 2014, Plaintiff requested an extension of time to respond to the Court's order to amend, and the Court granted Plaintiff an additional sixty days to comply. Plaintiff has now written several letters to the Court seeking another extension of time or, in the alternative, a stay. Plaintiff also seeks appointment of counsel. The factors to be considered in ruling on a motion for pro bono counsel include the merits of the case, Plaintiff's ability to pay for private counsel, Plaintiff's efforts to obtain a lawyer, the availability of counsel and Plaintiff's ability to gather the facts and deal with the issues if unassisted by counsel. Cooper v. A. Sargenti Co., 877 F.2d 170, 172 (2d Cir. 1989). Of these, the merits are "[t]he factor which command[s] the most attention." Id. Because it is too early in the proceedings for the Court to assess the merits of the action, Plaintiff's motion for counsel is denied without prejudice to renewal at a later date. The Court denies Plaintiff's application for a stay, but grants Plaintiff's request for another extension of time. Plaintiff must submit an amended complaint within sixty days of the date of this order. Within that time, Plaintiff should be able to provide the Court with whatever facts are available that support her FLSA claim. No further extensions of time will be granted.
