ORDER OF SERVICE: To allow Plaintiff to serve the defendant(s) using the U.S. Marshals Service, the Clerk of the Court is directed to send Plaintiff one U.S. Marshals Service Process Receipt and Return form ("USM-285 form") for each defendant. ORDER: The Court informed Plaintiff in its March 16, 2015 order that court staff can answer only procedural questions. For this reason, court employees cannot tell Plaintiff when her documents are due or whom she should sue. Plaintiff may not think that these are legal questions, but they are. Court employees are available solely to distribute forms and accept filings, not to interpret their contents. It is also not the job of court employees to tell Plaintiff the exact time at which a document was filed. ORDER: By order dated October 28, 2014, the Court granted Plaintiff sixty days to amend her complaint to provide facts supporting her Fair Labor Standards Act ("FLSA") claim. The Court directed Plaintiff to explain the manner in which the union's actions were arbitrary, discriminatory, or in bad faith. By letter dated December 2, 2014, Plaintiff requested an extension of time to respond to the Court's order to amend, and the Court granted Plaintiff an additional sixty days to comply. Plaintiff has now written several letters to the Court seeking another extension of time or, in the alternative, a stay. Plaintiff also seeks appointment of counsel. The factors to be considered in ruling on a motion for pro bono counsel include the merits of the case, Plaintiff's ability to pay for private counsel, Plaintiff's efforts to obtain a lawyer, the availability of counsel and Plaintiff's ability to gather the facts and deal with the issues if unassisted by counsel. Cooper v. A. Sargenti Co., 877 F.2d 170, 172 (2d Cir. 1989). Of these, the merits are "[t]he factor which command[s] the most attention." Id. Because it is too early in the proceedings for the Court to assess the merits of the action, Plaintiff's motion for counsel is denied without prejudice to renewal at a later date. The Court denies Plaintiff's application for a stay, but grants Plaintiff's request for another extension of time. Plaintiff must submit an amended complaint within sixty days of the date of this order. Within that time, Plaintiff should be able to provide the Court with whatever facts are available that support her FLSA claim. No further extensions of time will be granted. ORDER: By order dated October 28, 2014, the Court directed Plaintiff to amend her complaint within sixty days. On December 2, 2014, Plaintiff submitted a letter requesting an extension of time to respond to the Court's order to amend her complaint. (See ECF Docket No. 5.) The Court grants Plaintiff's request for an extension of time and directs Plaintiff to file an amended complaint within sixty days of the date of this order. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
