MEMORANDUM OPINION AND ORDER re: 10 MOTION to Dismiss Notice of Motion to Dismiss the Complaint. filed by U.S. Bank National Association. For the foregoing reasons, Defendant's motion to dismiss the complaint is granted in part a nd denied in part.
