OPINION & ORDER re: 42 MOTION to Dismiss First Amended Complaint, filed by Certified Safety services of N.Y., LLC, Certified Safety Services, Inc., Michael Gianatasio. For the foregoing reasons, the Moving Defendants' Motion i s GRANTED. Plaintiffs' RICO claims are dismissed with prejudice and without leave to replead, and his remaining state claims are dismissed without prejudice.
