October 11, 2018 Opinion or Order Filing 105 OPINION AND ORDER re: 94 MOTION to Dismiss filed by Macy's East. For the reasons set forth above, Defendant's motion to dismiss is GRANTED. Though the Court is unable to provide Plaintiff with the relief she seeks, it a ppreciates the diligence and sincerity with which Plaintiff has pursued her claims. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that any appeal from this order would not be taken in good faith; therefore, in forma pauperis status is denied for purposes of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is directed to terminate all pending motions, adjourn all remaining dates, and close this case. SO ORDERED. May 25, 2017 Opinion or Order Filing 79 OPINION AND ORDER re: 65 MOTION to Compel Arbitration , filed by Macy's East. The Court is sympathetic to Plaintiff's expressed concerns about the arbitration process generally and her prior arbitration experience in parti cular. The Court expects that Defendant and the arbitrator will each do their part to ensure that Plaintiff is treated with dignity and that her claims are given appropriately thoughtful consideration. That said, the facts and law are clear that Plai ntiff's claim must proceed to arbitration. Accordingly, and for the reasons set forth above, Defendant's motion to compel arbitration and stay this case is GRANTED. This case is STAYED pending the resolution of the parties' arbitration . To this end, Defendant is ORDERED to file a letter with the Court on or before June 26, 2017, setting forth a timeline for the parties' arbitration. November 29, 2016 Opinion or Order Filing 61 OPINION AND ORDER. For the foregoing reasons, MRH's motion to dismiss is GRANTED IN PART and DENIED IN PART. All claims but Plaintiff's EPA claim are dismissed. The Clerk of Court is directed to terminate the motion at Docket Entry 52.
