OPINION AND ORDER re: 56 MOTION to Dismiss for Lack of Jurisdiction , MOTION for Summary Judgment filed by The United States of America. For the foregoing reasons, the Court DENIES Defendants' motion for to dismiss fo r lack of subject matter jurisdiction, GRANTS the Government's motion for summary judgment on Plaintiffs' informed consent claims, and DENIES the motion for summary judgment on the negligent exposure claim.
