ORDER: Magistrate Judge Jeremiah J. McCarthy's Report and Recommendation 58 is adopted as modified in the attached Decision and Order. The government's motion to treat defendant's counterclaim as an affirmative defense 43 and its motion to dismiss the counterclaim for lack of subject matter jurisdiction 50 are denied. The government's motion for additional time to respond to the counterclaim is granted through and including October 8, 2014.
