FURTHER that Defendant Board's Motion to Dismiss [Doc. # 14 ] Plaintiffs' S.F. I claim is GRANTED pursuant to Federal Rule of Civil Procedure 12(b)(6), and Plaintiffs' S.F. I claim is DISMISSED as time-barred. FU RTHER that Defendant Board's Motion to Dismiss [Doc. # 14 ] Plaintiffs' S.F. II claims is GRANTED pursuant to Federal Rule of Civil Procedure 12(b)(1), and Plaintiffs' S.F. II claims are DISMISSED WITHOUT PREJUDICE to Plaintiff 9;s re-filing such claims after exhausting the applicable state administrative remedies. FINALLY that Plaintiffs' Motion for Appointment of Guardian Ad Litem [Doc. # 32 ] is DENIED as MOOT, as there are no remaining claims in the action.
