ORDERED that Defendant's Motion to Dismiss Plaintiff's Third and Fourth Cause of Action (Doc. 6 ) is GRANTED and these claims will be DISMISSED WITHOUT PREJUDICE. FURTHER ORDERED that Plaintiff shall have ten (10) days from the entry of this Memorandum Opinion and Order to file an amended complaint. Plaintiff's complaint (Doc. 11 ) may be amended for the lim ited purpose of waiving all damages in excess of $10,000 in Plaintiff's third cause of action, her breach of contract claim. If Plaintiff chooses not to file an amended Complaint, the third cause of action will be dismissed without prejudice in accordance with this Opinion. (Butler, Carol)
