MEMORANDUM OPINION AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE L. PATRICK AULD signed on 8/4/2015, RECOMMENDING that the Commissioner's decision finding no disability be vacated and that the matter be remanded under sentence fou r of 42 U.S.C. § 405(g), for further administrative proceedings to include: (1) reevaluation with proper explanation of whether Plaintiff's mental impairments meet or equal the criteria of any listed impairment; (2) reconsideration of th e opinions of Drs. Perkins and Spencer and an explanation conforming with 20 C.F.R. § 416.927 as to the relative weights afforded each opinion; and (3) redetermination of whether any of Plaintiff's prior work constitutes PRW and, if so, the mental demands of such work and whether Plaintiff retains the RFC to return to such work. As a result, Defendant's Motion for Judgment on the Pleadings (Docket Entry 13 ) should be denied and Plaintiff's Motion for Judgment on the Pleadings (Docket Entry 11 ) should be granted in part (i.e., to the extent it requests remand).
