Memorandum Opinion and Order: Plaintiff's motion to remand (Doc. No. 8 ) is denied. Defendant's unopposed motion to dismiss Counts I and II of the complaint (Doc. No. 6 ) is granted, and plaintiff's state law claims for negligence and breach of contract are hereby dismissed with prejudice. This case shall proceed only as to plaintiff's claim pursuant to the Carmack Amendment (Count III). Judge Sara Lioi on 2/20/2013. (P,J)
