June 4, 2012 Filing 2 Judgment Entry: This Court hereby ACCEPTS the Proposed Findings of Fact and Conclusions of Law In Support of Entry of Default, and hereby enters judgment as follows: a) On Count I of the Complaint: the Court hereby finds that the Defendant is in default of the loan that is the subject of this Complaint; and b) On Counts I and II of the Complaint: The Court hereby enters judgment in favor of the Trustee and against the Defendant in the amount of $145,966.12, inclusive of $100,000.00 in loans up to the principal amount listed in the Promissory Note, $25,505.18 in interest at the regular rate and $1,267.19 in Late Fees based on those interest payments accrued on that amount, and $4,193.75 in After Due Date Rate interest and $15,000.00 in Late Fees based on those interest payments accrued on that amount; and c) On Count II of the Complaint: The Court hereby finds that the Defendant was unjustly enriched by the additional loans made in excess of the principal amount evidenced by the Promissory Note that are the subject of the Complaint; and d) On Count II of the Complaint: The Court hereby enters judgment in favor of the Trustee and against the Defendant in the amount of $88,123.12, inclusive of $88,123.12 in additional loans made in excess of the principal amount evidenced by the Promissory Note; and e) On Counts III and IV of the Complaint: The Court hereby finds that the transfers that are the subject of the Complaint, as listed on Exhibit C to the Complaint, are avoidable as fraudulent transfers under Ohio's Uniform Fraudulent Transfer Act (Ohio Revised Code 1336.01, et seq.); and f) On Counts III and IV of the Complaint: The Court hereby enters judgment in favor of the Trustee and against the Defendant in the amount of $173,323.12; and g) On all Counts, post-judgment interest on the judgment is hereby awarded as specified in 28 U.S.C. 1961.
