Filing 24 Memorandum Opinion and Order: Defendants' respective motions to dismiss (Doc. Nos. 15 , 16 and 17 ) are granted in part and denied in part. They are granted as to the sole federal claim in the first cause of action set out in the firs t amended complaint and denied as to the two state claims set out in the second and third causes of action. The Court declines supplemental jurisdiction, pursuant to 28 U.S.C. Section 1367(c)(3), and dismisses the second and third causes of action wi thout prejudice. Pursuant to 28 U.S.C. Section 1915(a)(3) and Fed. R. App. P. 24(a)(3)(A), the Court certifies that an appeal from this decision could not be taken in good faith because the teachings of the case law set forth herein preclude plaintiff's federal cause of action.
