ORDER: adopting 42 Report and Recommendation. The Court HEREBY ORDERS the following: (1) FCI Defendants' 32 Motion to Dismiss, or in the Alternative, for Summary Judgment is GRANTED; (2) Defendants St. Marys/Elk Regional Hospital and Kane C ommunity Hospital are DISMISSED without prejudice; (3) Defendant Dr. Rudick's 26 Motion to Dismiss is GRANTED.
