ORDER granting in part and denying in part #74 Motion. Plaintiff's request to extend discovery is denied. Several months remain until the deadline for expert discovery closes and, as set forth in the Court's December 20, 2013 Order (Doc. #68 , paragraph 2), the Court does not envision any additional extensions of the discovery period in what is almost a two-year old case. In addition, the Court finds no clarification necessary with regard to the documents Mr. Rupert offered, and was ordered, to produce. See Doc. #66 . Following the voluntary dismissal of his claims, Mr. Rupert's attorneys promised to produce "all expert reports generated to date by his attorneys, together with all other pre-trial preparatory documents and information in their possession related to the Ford litigation." A review of the exhibits submitted by Plaintiff demonstrates that Mr. Rupert's attorneys have produced a considerable number of documents. To the extent his attorneys now represent that all contemplated documents have been produced (absent documents they contend are privileged), the Court sees no reason to question his attorneys' representations. To the extent Mrs. Rupert's attorneys seek specific documents that have not been produced, they should make such a request. As to Plaintiff's request to depose Mr. Rupert, the Court notes that during the February 3, 2014 status conference, counsel for Mr. Rupert and counsel for Mrs. Rupert entered into a "gentleman's agreement" to make Mr. Rupert available for a deposition without the need for subpoena. The Court expects counsel to abide by that agreement, and make Mr. Rupert available for a deposition within 30 days of this order.
