MEMORANDUM OPINION AND ORDER granting 42 Motion to Dismiss for Failure to State a Claim, as explained therein. The RICO claims in Counts XII and XIII are dismissed as to Autumn Andreis, Gary Andreis and Ultimate Landscaping; the Court declines to ex ercise supplemental jurisdiction over the state law claims in Counts III, IV, V, VI and VIII as to those Defendants; and they are dismissed as parties. Defendants' Motion to Dismiss the original complaint 36 and Defendants' Motion to Substitute Attorney 21 are denied as moot.
