MEMORANDUM OF OPINION AND ORDER re 152 MOTION for Judgment as a Matter of Law. Defendant's motion for judgment notwithstanding the verdict is DENIED. Defendant's motion for new trial is GRANTED, conditioned upon the refusal of Plainti ff Gonzalez to remit $5,400,000. If Plaintiff agrees within thirty days of the date of this order to the reduced award of $600,000.00, Defendant's motion for new trial shall be denied.
