(The dismissal of the "negligent failure to protect" claim is dismissed w ithout prejudice to being brought in state court.) If Plaintiff so chooses, he may file an Amended Complaint containing only his "retaliation" claim. If Plaintiff decides to proceed with his retaliation claim and his 2 Application to Pro ceed In Forma Pauperis, he may file a certified copy of his Inmate Account Statement at the same time he files his Amended Complaint.
