MEMORANDUM OPINION AND ORDER that Defendant's Renewed Partial Motion to Dismiss 20 is GRANTED in part and DENIED in part. Accordingly, the following claims are hereby DISMISSED: any discrete claim for discrimination under 167; 1981, Title VII, or the ADA arising from workplace drug testing that occurred in October 2009, and any discrete claim for discrimination under Title VII or the ADA arising from workplace drug testing that occurred in October 2010.
