May 11, 2016 Opinion or Order Filing 72 FINAL JUDGMENT - This action came for trial on April 19, 2016. Plaintiff Vendetta D. Hardy and Defendant Caterpillar Global Mining Equipment, LLC (Caterpillar) appeared and announced ready. As a jury had previously been requested, the Court impaneled and swore eight jurors who heard the evidence and arguments of counsel. After Plaintiff rested her case in chief, Defendant filed a Motion for Judgment as a Matter of Law (Dkt. 59). After hearing argument, and for reasons stated on the record, the Court DENIED Defendants motion as to Plaintiffs discrimination and retaliation claims and GRANTED the motion as to Plaintiffs Equal Pay Act claim and her claim for punitive damages in an Order dated April 22, 2016 (Dkt. 69). Following the arguments of counsel and the charge of the Court, the jury retired to deliberate. Thereafter, also on April 22, 2016, the jury reached a unanimous verdict, finding in favor of Defendant and against Plaintiff on all the remaining claims (Dkt. 66). Having reviewed the verdict, the Court is of the opinion that Defendant Caterpillar is entitled to judgment. It is, therefore, ORDERED that judgment is entered in favor of Defendant Caterpillar and against Plaintiff Vendetta Hardy and that Plaintiff take nothing by way of the claims asserted against Defendant Caterpillar. It is further ORDERED that all taxable costs of court are taxed against Plaintiff Vendetta Hardy. This judgment is intended to be FINAL for purposes of appeal. The Judgment disposes of all parties to this action and all claims. All relief requested by any party to this action not expressly granted herein is DENIED. Signed by Magistrate Judge Don D.
