ORDER. The Court has reviewed the Report and Recommendation 50 for clear error and finds none. It is therefore ORDERED that the findings and conclusions in the Report and Recommendation are hereby ADOPTED as the findings and conclusions of the Cour t. Accordingly, Defendant Whitesides' motions to dismiss 38 and 49 are GRANTED to the extent that they seek dismissal under Federal Rule of Civil Procedure 12(b)(5) and DENIED AS MOOT to the extent that they seek dismissal under Federal Rule of Civil Procedure 12(b)(6). Defendant Thomas A. Whitesides, Jr. is TERMINATED as a party to this case. This case is returned to the docket of the Honorable E.
