The Court, having considered the parties' joint motion, applicable law and the record, is of the opinion that the Motion should be GRANTED. It is therefore: ORDERED that Plaintiff Milton Allen's causes of action against Defendants KRGP Inc. and Kroger Texas LP d/b/a America's Beverage Company (collectively "ABC") are hereby dismissed with prejudice to the Plaintiff's right to refile same; it is further ORDERED that Plaintiff take nothing from ABC; and it is further ORDERED that each party will be responsible for the respective court costs and attorney's fees that each incurred.
