AGREED ORDER ON MOTION TO DISMISS: Pending before the Court is the parties Joint and Agreed #17 Motion to Dismiss with Prejudice. The Court, having considered the parties' joint motion, applicable law and the record, is of the opinion that the Motion should be GRANTED. It is therefore: ORDERED that Plaintiff Milton Allen's causes of action against Defendants KRGP Inc. and Kroger Texas LP d/b/a America's Beverage Company (collectively "ABC") are hereby dismissed with prejudice to the Plaintiff's right to refile same; it is further ORDERED that Plaintiff take nothing from ABC; and it is further ORDERED that each party will be responsible for the respective court costs and attorney's fees that each incurred.
