ORDER granting Motion to re-open Motion to Vacate under 28 U.S.C. 2255 as to Darrell K. Phillips (1) and denying Motion to appoint counsel. Because pltf's Sec. 2255 petition is being reinstated, it is hereby ORDERED that 1) Clerk of the Court to serve upon the US Attorney for Dist. of VT a copy of pltf's habeas corpus motion; 2) The govt shall within 30 days after service file an answer; 3) Pltf shall file any response to the govt's answer within 30 days after the govt's answer is filed with the Court.
