Filing 53 OPINION AND ORDER - the Court hereby DENIES Defendants' Motion for Summary Judgment in its entirety as it finds that the evidence has clearly shown by apreponderance thereof that Defendants themselves were negligent. Moreover, there are many fac tual disputes which must be addressed prior to any determination of liability or the degree of liability. Since the Courtis able to rule on Defendants' Motion for Summary Judgment without requiring further briefing from Plaintiff, Plaintiffs request (Docket Number 37) is MOOT.
